Terms of Service

1. Acceptance of Terms

By accessing or using the AceXCode desktop application and associated services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 18 years old to use AceXCode. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

• You must provide accurate and complete information during registration
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized access to your account
• One account per individual; sharing accounts is not permitted
• Device registrations are limited based on your subscription plan

4. Subscription and Billing

• AceXCode offers subscription plans with monthly credit allowances
• Each action (AI query, transcription segment, screenshot analysis) consumes 1 credit
• Unused credits do not roll over to the next billing period
• Additional credit top-up packages may be purchased at any time
• Payments are processed securely through Razorpay
• Subscription fees are billed at the start of each billing period
• Price changes will be communicated at least 30 days in advance
• Refunds are subject to a non-refundable reversal fee of &rupee;20 to cover payment gateway charges (see our Refund Policy)

5. Acceptable Use

You agree not to use AceXCode to:

• Violate any applicable laws, regulations, or third-party rights
• Engage in academic dishonesty, unauthorized exam assistance, or cheating of any kind
• Misrepresent AI-generated content as your own original work in any formal evaluation
• Reverse-engineer, decompile, or disassemble the application
• Circumvent usage limits, licensing restrictions, or security measures
• Redistribute, resell, or sublicense the Service without authorization
• Use automated tools to abuse the Service's API or infrastructure
• Transmit malware, viruses, or other harmful code through the Service

6. Intended Use

AceXCode is designed as an interview preparation and mock interview tool. The Service is intended for:

• Mock interviews and practice sessions with peers, mentors, or coaches
• Personal skill development and interview technique coaching
• Reviewing and studying technical concepts in an interview-like format
• Preparing and rehearsing responses for common interview scenarios

You are solely responsible for how you use the Service and any consequences that arise from your use. AceXCode does not endorse or encourage any use of the Service that violates the policies of employers, educational institutions, or assessment platforms.

7. Intellectual Property

The AceXCode application, including its source code, design, branding, and documentation, is the intellectual property of AceXCode and is protected by applicable copyright and trademark laws.

You retain ownership of any content you input into the Service (such as resumes or interview context). We do not claim ownership of your content.

8. AI-Generated Content

Responses generated by AceXCode are provided for informational and preparation purposes only. We do not guarantee the accuracy, completeness, or appropriateness of AI-generated answers. You are responsible for reviewing and using AI-generated content at your own discretion.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted or error-free access to the Service. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control. We are not liable for any downtime or service interruptions.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

AI-generated responses are provided for informational and preparation purposes only. We make no guarantees regarding the accuracy, completeness, reliability, or suitability of any AI-generated content. You use the Service and its outputs entirely at your own risk.

11. Limitation of Liability

To the maximum extent permitted by applicable law, AceXCode and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to loss of data, loss of profits, or interview outcomes.

Our total aggregate liability for any claims related to the Service shall not exceed the amount you paid for the Service in the 3 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless AceXCode, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Service in a manner that violates these Terms or any applicable law
• Your use of the Service in connection with any formal evaluation, examination, or assessment in violation of the policies of the administering organization
• Any content you submit to or generate through the Service
• Any third-party claim resulting from your use of AI-generated content

This indemnification obligation survives termination of your account and these Terms.

13. Termination

• You may terminate your account at any time through your account settings or by contacting support
• We may suspend or terminate your account at our discretion for violations of these Terms, abusive behaviour, or fraudulent activity
• Upon termination, your access to the Service will cease and unused subscription credits will be forfeited
• Purchased credit top-up balances on accounts terminated for Terms violations are non-refundable
• Provisions that by nature should survive termination (including Sections 10, 11, 12, and 14) will remain in effect

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in India.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
